SAUDI ARABIAN CUSTOMS AUTHORITIES ‘’MADE IN …’’ INSTRUCTIONS

All items (equipment/ materials/ goods) with final destination Saudi Arabia shall meet the following Saudi Arabian Customs’ instructions, without any exception, for cargoes arriving and entering said country through whatever means of transport or Saudi Arabia Customs Office. SELLER shall verify that these instructions are in full force and effect in Saudi Arabia on the PO signature date.

  1. All items entering Saudi Arabia must show in which country they were made in and shall be marked accordingly, using as ORIGIN MARKS with one of the two following wordings:

“Made in … (+ Name of the Country of Origin)’’

Or

“Country of origin ……………. (+ Name of the Country of Origin)’’1

Or

“Assembled in … (+ Name of the Country of Assembly)”, only for casesdefined in instruction 11

Not only the item itself but also the outer packaging of the item shall be marked in this way, showing the marking of the item inside the packing, so the ORIGIN MARKS are clearly visible for the Customs Authorities.

  1. The following examples show wordings that are not accepted in the ORIGIN MARKS:
  • ‘’Made in Madrid’’ shall not be acceptable. Instead: ‘’Made in Spain’’ or ‘’Country of Origin Spain’’ shall be used.
  • ‘’Made in NL’’ shall not be acceptable. Instead: ‘’Made in Netherlands’’ or ‘’Country of Origin Netherlands’’ shall be used.
  • ‘’Made in Oklahoma’’ shall not be acceptable. Instead: ‘’Made in USA’’ or ‘’Country of Origin USA’’ shall be used.
  1. The only accepted abbreviations for countries are:
  • “Made in/Country of Origin USA”.
  • “Made in/Country of Origin UK”.
  • “Made in/Country of Origin UAE”.
  1. The size of the ORIGIN MARKING is not relevant as long as it is readable an indelible.
  2. The ORIGIN MARKING of the item and of the outer packaging shall be painted or stamped with non-removable ink or paint, engraved or written down on an irremovable tag/name plate attached or screwed to the item. Such plates shall not have any detrimental effect on the item. Marking made by hand with a non-removable marker is also acceptable. A sticker or piece of paper or writing that can be wiped off is NOT acceptable as well as any other easily removable marking. The preferred method of marking item is engraving.
  3. SELLER shall verify that the “tag/name plates” of the item and/or different “packing appliances” - either cartons, plastics, pallets, bags or any kind of container- do not contain any indication of the country of where these particular “tag/name plates” or “packing appliances” have been fabricated which could be mistaken with the ORIGIN MARKS. In such event, SELLER shall remove those indications before the shipment to avoid any possible confusion in the final destination. Special care is advised on this regard to SELLER, when receiving items from a SELLER’S PROVIDER. If the origin indications cannot be removed, they shall be included in the documents and on the outer packaging.
  4. When items and/or its packaging contain names of cities or countries which are not the actual origin place of the item, as for example when the address of the headquarters of SELLER or SELLER’S PROVIDER is included as part of the standard nameplate, SELLER shall correct these situations prior to shipment by removing such cities/countries or by including them in both the formal marking as an additional ORIGIN MARKS along with the actual origin of the material, and in all the related shipping documents issued. If the Customs Authorities detect a name of a country or city anywhere attached/placed on the item that is not officially declared as the origin and marked properly following these instructions, the items will be deemed as a non-declared origin goods by the Authorities. SELLER shall bear the consequences of not fulfilling this requirement, including the costs of any fine which Authorities may impose.
  5. For small pieces as bolts, nuts, chains and the like, where there is no space available to insert the ORIGIN MARKS, or in case of materials whose composition presents a non-solid surface or would not allow direct marking, as liquids or special surfaces, the ORIGIN MARKING shall be made on the box/bag/tube or any kind of packaging that contains the material. For example, in the case of small size screws, these can be placed into a plastic bag and the bag will have to be properly marked before final packaging (and the outer packaging to be marked also with the origin place, as instructed above).
  6. When items with different origins are enclosed in the same outer packaging, the ORIGIN MARKS of this packaging shall show all the different origin places. Such places shall be shown in the relevant documents as well. For example, if the package includes materials that are marked with China, USA and France origins, an ORIGIN MARK with the text “Made in China, USA and France” shall be placed on the outer packaging and this text shall be shown in the related documentation.
  7. Assemblies made of a main component and one or more sub-components whenever they have been manufactured in different countries, shall be marked with the country where the assembly is done. This ORIGIN MARK shall be included on the body of the main component, as well as in the packaging containing this assembly. Whenever any of the components which made up the assembly have their origin countries visibly marked, such countries shall be listed in the corresponding Commercial Invoice and Certificate of Origin and outer packaging. If the components of an assembled item have different origins and some of them are not marked, there is no need to mark them as it is enough with the ORIGIN MARK for the complete assembled item. Any non-marked origin shall not be required to be mentioned in any of the related documents.

Materials/items that are not attached to it or assembled into it, when packed as loose items in the same CARGO of the equipment/item, even if the equipment/item and the loose materials/items have the same origin shall contain their own individual ORIGIN MARK. Whenever the origin of any loose item is different from the origin place of the assembly, it shall be included in the related document and on the outer packaging. In some cases (e.g. loose items as spare parts or SPECIAL TOOLS), a separate Commercial Invoice, Packing List and Certificate of Origin must be issued as well, even if the items are packed in the same CARGO.

  1. If the materials or components are mounted or assembled in a packaged unit, it is also acceptable to mark the item with “Assembled in…” irrespective of if its parts come from one or several countries of origin. For the individual components and loose items, the instructions of the previous point shall apply.
  2. It is SELLER´s responsibility to flow down these instructions to its SELLER’S PROVIDERS and to ensure its fulfilment.
  3. Bulk material not related to an assembly/packaged unit (as steel plates, tubes, piping, etc.) shall comply with the ORIGIN MARKING requirement consisting of individual marking per piece or component.
  4. ORIGIN MARKING may be part of the tags/nameplates inserted in each piece or component. The tags/nameplates will not be rejected if they do not have this information, provided that the concerned piece or component duly has its ORIGIN MARK elsewhere.
  5. In case of any doubt, SELLER and its SELLER’S PROVIDERS shall be restrictive and keep in mind that the applicable documents for the items shall match the marking both on the items itself and on the related outer packaging.
  6. The ORIGIN MARKS both of the item and of the packaging shall be shown to the BUYER’s inspector during packaging inspection. In case any of these marks are not available during packaging inspection or if the inspection is not made by the BUYER’s inspector in person, SELLER shall send to BUYER photos showing the correct ORIGIN MARKING of both items and outer packaging after the inspection.
  7. For any item entering Saudi Arabia without the correct ORIGIN MARKING, the Saudi Arabian authorities will not allow to remedy the ORIGIN MARKING at the arrival of it. If not correctly marked, the full consignment will be stopped at Customs, the importer will be heavily penalized and such cargo will have to be returned to the suppliers’ country of origin without any possibility of reconsideration from Customs side. Any demurrage, fine, detention, extra labour and/or any other kind of extra costs, including return freight and its consequences, as well as others than the Saudi Arabian Customs Offices may impose, derived from any SELLER’s/SELLER’S PROVIDERS’ failure to fulfil the instructions on this document, shall be at SELLER´s sole cost and responsibility.
  8. Any other situation not covered by these instructions shall be solved using logic and common sense. Should SELLER have any doubt, BUYER shall be consulted about.
