PURPOSE AND SCOPE
1.001 This document defines and governs the HSE principles applicable to the ORDER, of which it is an integral
part.
1.002 Unless otherwise expressly mentioned, all requirements included in this document to be fulfilled by
SELLER shall be fulfilled as well by SELLER’S PROVIDERS, as applicable.
1.003 The purpose of this document is:
a) to establish the HSE requirements that SELLER shall fulfil in the bidding phase.
b) to establish the HSE requirements that SELLER shall comply for the SUPPLY and the
SERVICES, as the case may be.
c) to define the HSE documentation that SELLER shall provide since the COMMENCEMENT
DATE, as well as the information that shall be included in it.
d) to give general instructions on the coordination activities between BUYER and SELLER for the implementation of HSE activities and documentation requirements for the equipment, materials and services under SELLER´s scope.
2 DEFINITIONS AND ACRONYMS
2.001 Capitalized words and expressions in the wording correspond with definitions. All definitions and acronyms used in this document are defined in the Annex A of the PURCHASE CONDITIONS and shall be applicable to this document accordingly.
2.002 Additional relevant definitions and acronyms may be included in other documents forming part of the RFP
DOCUMENTATION, typically in the related Definitions section/chapter.
3 GENERAL PROVISIONS
3.001 SELLER shall comply with and shall enforce SELLER’S PROVIDERS all the requirements herein
included, at its own cost.
Likewise, it will be SELLER’s responsibility and obligation to get in touch with BUYER in case of any doubt or inability to comply with any of the requirements of this document.
3.002 SELLER shall be responsible for and shall document the HSE aspects of all the services, equipment and materials under its scope, and shall be responsible for all HSE activities to ensure that the requirements of the ORDER are met.
3.003 SELLER shall comply with all HSE local and national regulation applicable to its scope.
3.004 SELLER shall comply with all the HSE specifications and specifications of other disciplines where HSE
requirements are included.
3.005 SELLER shall comply with all the HSE requirements indicated in any of the international standards
indicated in any document of the ORDER.
3.006 SELLER shall comply with the requirements of regulations and codes of practice relating to HSE, which may apply to personnel working, services and/or supply at the related premises in the performance of its obligations under the ORDER.

3.007 Any remedies required to comply with any of the provisions established in this document, related to
SELLER and/or SELLER’S PROVIDERS responsibilities, shall be borne by SELLER.
4 HSE POLICY AND MANAGEMENT SYSTEMS
4.001 SELLER shall ensure that its HSE policy statement is made available to BUYER (and OWNER, if
required), on request.
4.002 SELLER shall establish and shall maintain an HSE Management System for Health, Safety and Environmental management. These management systems shall be based on ISO 14001 and ISO 45001 standards, or, subject to BUYER’s approval prior to ORDER signature, any subsequent or equivalent standards.
4.003 SELLER shall promptly notify BUYER of any HSE hazards which may arise in connection with the
performance of its obligations under the ORDER.
4.004 SELLER shall comply with any HSE measures required by BUYER in respect of the staff and other
persons/subcontractors working under SELLER’s responsibility for the ORDER.
4.005 SELLER shall, when working on the premises others than its own and/or its SELLER’S PROVIDERS
premises, perform its obligations under the ORDER in accordance with the PROJECT HSE policies.
4.006 SELLER shall perform the SERVICES in accordance with the applicable government’s LAWS containing HSE requirements and guidelines of the country where the SERVICES are performed, which are, among others, to conserve energy, water, wood, paper and other resources, reduce waste and phase out the use of ozone depleting substances and minimise the release of greenhouse gases, volatile organic compounds and other substances damaging to health and the environment.
4.007 Throughout the term of the ORDER, SELLER shall provide information on new or improved environmentally preferable products when they become available and, where reasonably required, promote their use. Samples of such products shall be provided to BUYER for evaluation and for written approval before allowing a wider use within HSE.
4.008 SELLER shall co-operate with BUYER, at its own cost, in BUYER’s HSE Audits which BUYER or his
representative may undertake.
5 HSE DESIGN ASPECTS
5.001 SELLER shall comply with and shall guarantee that the design of the SUPPLY is in accordance with all the aspects related to HSE specified in 10651-00-091-0002 and in other documents included in the RFP DOCUMENTATION, as well as with the relevant LAWS and good industry practices.
6 HSE STUDIES SUPPORT AND ATTENDANCE
6.001 The following services shall be provided by SELLER, at its own cost:
a) SELLER shall provide technical support documentation to develop HSE studies.
b) SELLER shall attend, if required, HSE workshops studies.
c) SELLER shall answer and implement, when required, the recommendations/actions related
with its scope arisen from the HSE studies.

d) SELLER shall provide support to BUYER regarding the applicable Environmental Impact Assessment or environmental permitting providing the required support and/or documentation.

SELLER’S FACILITIES HSE REQUIREMENTS
7.001 The HSE Check List attached to Annex F of PURCHASE CONDITIONS will be filled in by BUYER’s resident Inspector during the first visit to the working facilities, being such process repeated periodically as long as visits are performed.
7.002 Based on the mentioned check list, if any concern is detected, SELLER and/or SELLER’S PROVIDERS shall carry out, at their own respective costs, all actions needed to improve the subject for getting a solution and to implement it in agreement with all involved parties.
7.003 BUYER will be entitled to keep OWNER informed about any outstanding issue regarding HSE and Social
requirements.
7.004 SELLER shall be responsible to ensure workers’, visitors’ and property’s health and safety by implementing the related HSE instructions, procedures and actions that prevents the risk of accidents, incidents and illness, and the like during the execution of the ORDER as per its/their own workshop health and safety management system, international standards and safe working practices.
7.005 All OWNER’s /BUYER’s personnel or others acting on behalf them shall be instructed by SELLER appointed personnel on any potential risk during the activities at workshop as well as emergency arrangements and measurements at place. They shall be escorted in the workshop and shall be provided with the necessary PPEs.
7.006 BUYER’s personnel will be entitled to register and maintain a record of all unsafe acts and conditions identified during the visit and will report them to SELLER for assessment and corrective actions implementation or general improvement, as applicable.
8 HSE REQUIREMENTS FOR SITE SERVICES
8.001 Unless otherwise indicated, the requirements set out in this clause shall be applicable for those SITE
premises subject to the related BUYER’s HSE management system.
8.1
HSE REQUIREMENTS FOR SELLER ENTERING THE SITE
8.1.001 Any SELLER’s personnel (advisor, technician, etc.) entering the SITE acting either as direct worker or as supervisor, shall comply with all applicable rules and regulations established in the SITE HSE Plan(s) and other HSE applicable documents as all other visitor/subcontractors of the PROJECT.
8.1.002 SERVICES consisting of only supervision works by SELLER at SITE will require, the submission by SELLER of the corresponding Method Statement (which will include a specific Risk Assessment) of the concerned activity for review and approval by BUYER prior SELLER is authorized to enter the SITE.
8.1.003 BUYER’s SITE HSE responsible shall be the focal point for HSE notifications in the PROJECT.
8.1.004 Without prejudice of other related provisions set out in the ORDER, before entering the SITE, the
following documentation shall be provided by SELLER:

a) Medical certificate (as protocol required to work, i.e. confined space), internal and external training needed in the related premise, medical insurance certificate, emergency contact details and PPE required in the PROJECT and any other applicable documentation required for the PROJECT.
b) Technical documentation: P&ID’s, lifting drawings, special tools, method statement, risk analysis for the activities to be performed, installation guidelines and commissioning and start up manual for commissioning activities and other documentation required for the PROJECT.
8.2
PROJECT INDUCTION AND TRAINING
8.2.001 Before entering the SITE, the SELLER’s personnel shall attend the applicable induction depending on
the length of its stay, as follows:
a) If the length of stay is less than 3 days, a reduced induction.
b) Otherwise, a full induction.
8.2.002 SELLER who undertakes high risk activities according to applicable SITE HSE Plan, e.g. confined
space, shall attend the appropriate OWNER/BUYER training program.
8.2.003 SELLER shall ensure that its personnel has completed the mandatory statutory training before engaging
in a concerned activity.
8.2.004 Upon BUYER’s request, SELLER shall be accompanied by a host when on SITE.
9 HSE GUARANTEES COMPLIANCE
9.001 SELLER, when applicable to the ORDER, shall comply with the PROJECT HSE guarantees limits of, as minimum, the following parameters in full compliance with local regulations and PROJECT relevant requirements specified in the PROJECT documents (i.e. the equipment specifications and the 10651-00- 091-0002):
a) Noise emission.
b) Pollutant air emissions
c) Dust emissions.
d) Effluent emissions
10 HSE DOCUMENTATION
10.001 SELLER shall send to BUYER all the documentation mentioned in this document following the requirements included herein and those applicable included in all other related documents forming part of the ORDER.
10.002 SELLER shall comply with the agreed dates for issuing such documentation.
10.003 SELLER shall provide the documents as established in the RFP DOCUMENTATION and in the 10651-
00-091-0002.
10.004 SELLER shall provide Safety Data Sheets for all the chemicals, lubricants, insulation and fireproofing
materials included in its scope.
10.005 SELLER shall provide, as part of the operation guidelines, the Safety Instructions for the installation,
maintenance and operation of the equipment, tools and/or systems under its scope.

COORDINATION
11.001 For technical aspects of HSE Services/Studies or Safety Equipment to be purchased, SELLER shall coordinate the activities with BUYER through its HSE Manager or the person in whom he/she delegates.
11.002 For HSE requirements requiring coordination at SITE, SELLER shall refer to BUYER´s Site HSE Manager.
11.003 For the avoidance of the doubt, HSE BUYER’s representatives in no way shall be entered into discussions
regarding neither invoicing/commercial issues nor design changes.
