2.3 Order of precedence

The EPC project shall be carried out based on the contract documents and fulfilling the requirements of any applicable Local Standards and Regulations. The order of precedence to adopt for the development of the Detail Design shall strictly follow the below sequence, in a top-down order, applied to both the relevant contractual documents and the regulatory references:

  1. The Contract body (the so-called Terms&Conditions) and all its annexes from Annex I to Annex XXIII,
  2. Local Regulations (for sake of clarity: the Algerian Law),
  3. Applicable nationals and international norms, codes and standards (last edition).

REMARKS:

a. Annex I prevails over all other Annexes; b. Within Annex I, the order of precedence is CEOT > DAO > Licensor / FEED documents. Within the CEOT and DAO, the higher number prevails upon the lower number (chronological order from the latest to the earliest); c. In case of conflict within the documents found at the same level of precedence, the most stringent requirement prevails.

3 COMPLIANCE WITH STANDARDS

3.1 General Requirements

tested, stored, installed and operable according to the latest edition of all applicable Laws, Norms, Codes, Regulations, Directives and Standards.

Each new Electrical Item/Installation part of the package units shall have all documentation certifications and marks as per applicable Laws, Norms, Codes, Regulations, Directives, and Standards.

3.2 Laws, Norms, Codes, Regulations, Directives & Standards

The design of Electrical system and equipment shall comply with all applicable latest edition of codes, regulations and standards for the plant location including the following, as applicable:

• Local Laws, Norms, Codes, Regulations and Directives issued by the Algerian Authorities

(National and/or Local Governments, Councils and Administrations)

• Prescriptions and Regulations issued by the Algerian Fire Brigade •

International Electrical Norms and Standards issued by the International Electro-technical Commission (IEC Standards) International Electrical Norms and Standards issued by the Institute of Electrical and Electronic Engineers (IEEE Standards) International Norms and Standards issued by the International Standard Organization (ISO Standards)

•

•

• Applicable recognized standards and codes (UTE, BS, VDE, etc.) Where IEC Publications

have not yet been issued.

In the particular cases in which no Codes, or Standards or Recommendations are available or applicable, the best engineering practices shall be applied after CLIENT’s approval.

In general, Codes and Standards issued by the Regulatory Bodies of the Country of origin of the items, materials, accessories, components, devices and/or equipment may be accepted, provided that the said Standards are equivalent or more restrictive than the base Codes and Standards to be applied for the Project.

The certification requirements for equipment to be installed in hazardous areas (ATEX and/or

IECEx) are detailed in the General Specification- Selection and Installation of Electrical Apparatus and material for use in Explosive and material for use in explosive gas atmosphere #4439-NN-SG-000000002

The application of stricter requirements than requested by the applicable Laws, Norms, Codes, Regulations, Directives and Standards is generally accepted, but it shall be technically justified and economically evaluated.

The adoption and the compliance with all Laws, Norms, Codes, Regulations, Directives, and Standards does not relieve VENDORs from the responsibility to design, to supply and to install each Electrical Item/System included in their scope of working such a way to assure the full functionality, the total adherence to the norms of safety and of good fabrication and installation.

If conflicts arise between the requirements included in the applicable Laws, Norms, Codes, Regulations, Directives and Standards issued by the above Regulatory Bodies, the stricter requirements shall be applied.

Under no circumstances shall this specification be interpreted as reducing the requirements of regulatory codes and standards. Compliance to Local Statutory Rules & Code of Practice is mandatory. Wherever the vendor notices any deviation in the specification from local requirement, the same shall be brought to the notice of Tecnimont (CONTRACTOR) and shall seek approval on the deviation.

The application of different or additional Laws, Norms, Codes, Regulations, Directives, and Standards shall be stated, in writing, to CONTRACTOR for its approval from CLIENT. Any doubt shall be resolved with the Client in writing through CONTRACTOR. The selection, design, construction, assembling, testing, storage, installation, and operation of each Electrical Item/System composing the package units shall also take into consideration all aspects related to safety, prevention of accidents, health, and conservation of the environment.

Therefore, each Electrical Item and/or each Electrical System composing the package units shall ensure what follows:

• Safety and health of the personnel under all expected operating conditions (both the

normal and predictable abnormal conditions).
